vendita dei beni ereditari, quando l\u2019eredit\u00e0 appartenga a soggetti incapaci, e redazione dell\u2019inventario. Muovendo dal quadro normativo (artt. 747 c.p.c., 471 ss. c.c. e riforma Cartabia), si chiarisce innanzitutto il quadro normativo in tema di autorizzazione alla vendita di beni ereditari, anche in ordine alla competenza. Indi si affronta il tema del ruolo dell\u2019inventario nella procedura di accettazione beneficiata da parte degli incapaci, chiarendo, anche alla luce della recente pronuncia delle Sezioni Unite della Cassazione n. 31310\/2024, che la dichiarazione di accettazione beneficiata produce comunque l\u2019acquisto della qualit\u00e0 di erede, anche prima della formazione dell\u2019inventario. Ne segue che l\u2019inventario non costituisce un presupposto indispensabile per il rilascio dell\u2019autorizzazione alla vendita ex art. 747 c.p.c., ferma restando la facolt\u00e0 del soggetto autorizzante (giudice o notaio) di richiederne la formazione in via istruttoria, qualora ritenuto utile alla valutazione degli interessi dei creditori e l\u2019annotazione con conseguente opponibilit\u00e0 ai terzi, perch\u00e9 l\u2019interesse perseguito \u00e8 gi\u00e0 ritenuto meritevole dalla norma (escludere il precedente titolare dall\u2019esercizio di qualsiasi potere attinente al rapporto ipotecario), nel caso di modifica dal lato passivo del rapporto (ossia la modifica del debitore), invece, occorre valutare se quella determinata norma possa essere considerata necessaria a proteggere interessi, diversi da quelli espressamente previsti, ma meritevoli in quanto rilevanti per il caso concreto, poich\u00e9 il debitore \u00e8 sempre tenuto ad adempiere la propria obbligazione indipendentemente dal creditore. Il presente studio muove da questo presupposto per verificare le ripercussioni dell\u2019assenza di obbligatoriet\u00e0 di annotazione sulla pienezza dell\u2019originaria iscrizione dell\u2019ipoteca a garanzia del credito quando avviene una modifica dal lato passivo del rapporto obbligatorio in ipotesi di accollo esterno liberatorio.<\/p>\n<p>I risultati permettono di ritenere che la mancata annotazione dell\u2019accollo liberatorio, sia condizionato sia incondizionato, indipendentemente dalla sua qualificazione in termini di successione nel debito o di novazione soggettiva, non pone particolari conseguenze sulla pienezza della garanzia e il creditore potr\u00e0 rivalersi sulla garanzia reale per l\u2019intero importo dovuto e sul complessivo valore del bene, trasferendosi il tutto in capo al debitore che si \u00e8 accollato l\u2019intero debito.<\/p>\n<p>Resta comunque ammissibile un\u2019annotazione facoltativa (con funzione meramente informativa), specialmente per l\u2019ipotesi di accollo esterno liberatorio condizionato, in quanto permetterebbe una semplificazione probatoria sia per il creditore sia per il debitore liberato, oltre a rendere immediatamente informati tutti coloro che avrebbero rapporti con il bene oggetto di ipoteca, in forza del principio di massima chiarezza delle operazioni giuridiche ed economiche.<\/p>\n<p>Tuttavia, almeno per il momento, le prassi delle Conservatorie sembrano rimanere ancorate sul principio di tassativit\u00e0 degli atti soggetti ad annotazione, con la conseguenza che, seppure ammissibile in linea teorica, la richiesta di annotazione dell\u2019accollo liberatorio potrebbe ricevere un rifiuto.<\/p>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-513766a elementor-widget
