The task force set up by the White House to study the possibility of attributing legal force to digital identities is one of a number of efforts addressing the lack of advance checks which is typical of common law systems. This lack certainly contributed, by way of identity theft, to the sub-prime phenomenon and “robo-signing” (falsification of documents to obtain illicit foreclosures), to the real estate crash and the foreclosure-gate scandal.
he facts have demonstrated the limits of security in countries that lack up-front checks and guarantees, unlike our system which is based on an advance check on the correctness of real estate transactions. For example, there are no land registries and this helps create uncertainty as to the ownership of a property or its unencumbered status.
The working group, together with representatives from the White House, the FBI and large companies that are interested in studying new mechanisms to improve the safety of documents and contracts, will be joined – under the collaborative relationship already set up between the National Council of Notaries and the common law countries – by three Italian notaries having extensive international experience, who have been called upon by the American Bar Association, the body that represents US lawyers.
