INFORMATION ON PRIVACY AND DATA SECURITY
A. The following are the rules observed by the National Council of Notaries to protect your privacy. Before providing us with your personal data, we invite you to take note of the general information below as well as any individual specific notifications published pursuant to Article 13 of Legislative Decree 196/03 relating to special services requiring the provision of personal data.
B. Collection of personal data
This note on privacy sets out the rules governing the collection and use of personal data by way of this website or other websites managed and/or owned by the National Council of Notaries (hereinafter “the site/s”). Use of the site implies authorization to collect data and information in the manner described in this note, in the information clauses at the end of the note, in the notifications published from time to time pursuant to Article 13 of Legislative Decree 196/03 as well as in accordance with the “Terms and Conditions for the Use of the Service”, which you are invited to peruse carefully before using the services offered. Personal data can also be gathered when you contact us to request information or when you register to use specific services and/or to access reserved areas and applications on the site. In these cases, we invite you to take note also of any additional information provided pursuant to Legislative Decree 196/03 before accessing such service and/or reserved area.
The National Council of Notaries respects and protects the privacy of its users.
In conformity with the relevant legal rules, the National Council of Notaries has put in place the necessary measures to protect your personal data. Should the user be assigned an ID and password to use in setting up the connection with the services offered by the National Council of Notaries, responsibility for the safekeeping of the ID and the password is exclusively the user’s.
The National Council of Notaries collects your personal data in order to offer services of access to data bases and other information and interactive services offered by the websites it owns and/or manages (hereinafter “the services”), as better described in the following paragraph.
C. Use of Personal Data
The National Council of Notaries may use your personal data for its own institutional ends, such as for example carrying out surveys or research for scientific or statistical purposes and/or sending communications regarding the Council’s activities and the services it offers its members, providing the services you sign up for, carrying out any activity relating to those services like, as an example only, quality checks on the services offered, the percentage of satisfied users, the communication of any problems or interruptions to the services, as well as for purposes inherent in the services such as market research, economic and statistical analyses, promotional information regarding new services, the sending of advertising/information/promotional material and updates on initiatives by the National Council of Notaries.
On this point, it could become necessary to pass your personal data to one or more associates of the National Council of Notaries. Such persons will in any case be obligated to use the data obtained from the National Council of Notaries only for the purposes indicated in this note.
D. Use of Cookies
The National Council of Notaries may use “cookies” to personalize browsing of the websites it manages. A cookie is a text file that is written on the user’s hard disk by a web server. It is not possible to use cookies to execute programs or infect your computer with viruses. Cookies are assigned individually to users and can be read exclusively by the web server that issued them. Cookies advise the web server that the user has returned to visit a particular web page.
The National Council of Notaries uses cookies to improve the sites it owns and the services they offer.
The user may accept or refuse cookies. Most browsers accept cookies automatically but usually it is possible to modify the browser settings to refuse cookies if the user so prefers. If the user chooses to refuse cookies, he or she may not however be able to make full use of the above websites and the services they offer.
E. Use of Beacons
This website may contain electronic images called web beacons, or “single-pixel GIFs” which allow the National Council of Notaries to count the users who have visited a page and to offer accessory and collateral services. Web beacons are not used to access personal data, but are simply a technique used to process overall statistics on the use of the website.
Web beacons collect only a limited set of information, such as a cookie number, the time and date when the page was viewed, as well as a description of the page on which the web beacon is included.
F. Changes to this Privacy Note
The National Council of Notaries reserves the right at any time, upon its own exclusive and unchallengeable initiative, to make changes to all or part of this present note on privacy and advise of the revision on the website itself. It is entirely the user’s responsibility to keep a constant eye on this. Your use of a website owned by the National Council of Notaries or of the services offered after changes have been made implies your agreement to the changes.
General Information on Privacy
1) Method of Processing and Nature of the Transfer of Data
Pursuant to Article 13 of Legislative Decree 196/03 , we inform you that your personal data, whose privacy and security we guarantee in full observance of the law cited and of existing regulations and EU laws, will be processed and communicated, including by electronic and in any case automated means, directly and/or by way of third parties only for purposes connected with the Council’s institutional ends, as well as for the use of the requested services.
Such purposes may be the carrying out of research or surveys with scientific or statistical objectives, information on the activities and initiatives of the Council, promotional information regarding new services and products produced or made available by the Council, the sending of advertising/information/promotional material and updates on initiatives by the Council.
2) Nature and Limits of the Transfer of Data
The transfer of your personal data is optional except where there is a legal requirement (e.g. for taxation purposes) and/or a contractual obligation to provide such data.
For access to some special services, the transfer of data may be indispensable for the use of the service. Refusal to transfer data will mean that in such cases it will be impossible to use the services offered.
Any data supplied will be processed only in accordance with methods and procedures that are strictly pertinent to the objectives indicated in this note.
3) Communication of Data
The detailed list of persons nominated as responsible for processing and the third parties to whom personal data may be divulged will be provided by the National Council of Notaries upon express request by the individual involved. 4) Rights Pursuant to Article 7 of Legislative Decree 196/03
With reference to processing by the National Council of Notaries, the following rights recognized by Article 7 of Legislative Decree 196/03 may be exercised:
“1. The person involved has the right to receive confirmation of the existence or otherwise of personal data regarding him or her, even if not yet input, and the communication of such data in an intelligible format.
2. The person involved has the right to receive information as to:
a) the origin of the personal data;
b) the means and objectives of processing;
c) the logic applied in the case of processing using electronic equipment;
d) the identity of the data owner, the managers responsible and the designated representative under Article 5, Paragraph 2;
e) parties and categories of parties to whom personal data may be divulged or who may acquire knowledge of the data in the vest of designated representative for the territory, manager or agent.
3. The person involved has the right to:
a) have the data updated, corrected or, if desired, completed;
b) have data that are processed in violation of the law cancelled, turned into an anonymous form or blocked, including those not needing to be kept for the purposes for which they were collected and subsequently processed;
c) receive confirmation that the operations, and the substance of the operations, under a) and b) above have been brought to the attention of those to whom the data had been divulged, except in the case where it proves impossible to do so or would require a use of resources which would be manifestly disproportionate with respect to the right being protected.
4. The person involved has the right to object in whole or in part:
a) for legitimate reasons to the processing of his or her personal data, even in a manner pertinent to the purposes for which they were collected;
b) to the processing of his or her personal data for the purpose of sending advertisements or mail-order material or of carrying out market research or commercial communications.”
